GTCs

1. general
These Terms and Conditions of Sale and Delivery apply to all quotations, order confirmations and deliveries of Elektrogros AG (hereinafter referred to as Elektrogros). Deviating provisions shall apply if they have been confirmed in advance and in writing by Elektrogros.

2. Offers
Open-ended quotations are non-binding until Elektrogros confirms the order.

3. prices
All prices are quoted in Swiss francs excluding VAT. The value added tax can be found in the respective offers and order confirmations. Prices shown in the webshop, brochures and catalogs are non-binding. Elektrogros reserves the right to adjust sales prices without prior notice (in particular due to market changes). A price adjustment is considered a new offer.

4. Liability and exclusion of liability
The liability of Elektrogros for damages due to delay in delivery, poor material and loss of profit is excluded to the extent permitted by law. Elektrogros is also not liable if the fulfillment of the contract is made difficult or impossible due to force majeure. Liability for auxiliary persons is excluded.

5. terms of payment
For new customers, delivery is made against advance payment. Existing customers can order against invoice after a successful credit check. Payments are to be made by the customer within 30 days of the invoice date without deduction of discounts and charges. Elektrogros may exclude individual means of payment in general or for specific contractual partners without further justification. In the event of late payment, Elektrogros is entitled to charge interest on arrears at the standard bank interest rate as well as reminder fees. Elektrogros may impose surcharges on individual means of payment.

6. Retention of title
The delivered products remain the property of Elektrogros until full payment has been made.

7. Warranty
Elektrogros grants a guarantee of 2 years on all its products. The contractual partner acknowledges that the decision on the type of defect rectification (replacement delivery, repair or credit note) lies with Elektrogros. The guarantee is a “bring-in” guarantee, i.e. the costs for returning the defective appliance to Elektrogros are borne by the customer.

8. dispatch
Dispatch is against invoice or advance payment and at the customer's risk.

9. shipping fee per parcel/delivery
The flat-rate shipping fee for deliveries within Switzerland is CHF 14.00 per parcel/delivery, regardless of the weight of the delivery (max. 31 kg per parcel / max. length 1 m). This includes packaging, insurance and postage costs. Parcels longer than 1m are bulky goods and will be charged separately in the shopping cart. Shipping is carried out by DHL Express, receipt is against signature. As a rule, delivery is made on the following day. Express deliveries on the morning of the following day are offered at an extra charge and are not available in all regions of Switzerland. Delivery on the following day and express additional services are the sole responsibility of the courier service and can therefore not be guaranteed by Elektrogros.

10. acceptance of deliveries
Deliveries must be checked for completeness by the customer immediately upon receipt. Complaints must be reported to Elektrogros within 10 days of receipt of the goods, stating the delivery note number. Deliveries shall be deemed to have been accepted if no written complaint is made within the time limit. In the event of a proven faulty or defective delivery, Elektrogros will provide a replacement or a credit note, provided that the complaint is made in writing and in good time. Further claims for compensation are excluded.

11. Invoices
Invoices must be checked immediately upon receipt. The invoice amount shall be deemed accepted if no written complaint is made within 10 days of receipt of the invoice.

12. Returns
Returns of correctly delivered goods require the consent of Elektrogros and must be notified in writing within 10 days of receipt of the delivery. Items that come from a manufacturer that does not accept returns, are not in their original packaging, are incomplete or are no longer as good as new cannot be returned. Electronic components such as transformers, LED power supplies, LED strips or LED circuit boards as well as items ordered at the customer's request cannot be returned. In the event of a credit note, Elektrogros reserves the right to deduct a handling fee. Storage and transportation costs already paid are to be settled by the customer.

13. illustrations and technical specifications
Illustrations and technical specifications on the webshop, in brochures and in catalogs are not binding.

14. Copyright
The reproduction and copying of texts, designs or images on the domain www.elektrogros.ch requires the consent of the management of Elektrogros.

15. Place of jurisdiction, place of performance and applicable law
The place of jurisdiction and place of performance is 8952 Schlieren. Swiss law is exclusively applicable.

16. final provisions
Should individual provisions of these GTC be or become invalid, the remaining provisions shall retain their legal validity. Elektrogros reserves the right to amend the GTC at any time.
